GET LEGAL ADVICE

It is useful to understand the range of possible outcomes if you were to go to court and what the most likely outcome would be. By obtaining legal advice, you will be able to negotiate better and make informed decisions.

KNOW YOUR LIMITS

Have a clear view of what you are willing to compromise. You should also be clear about the areas in which you are confident that you would get the outcome you are hoping for if you chose to pursue legal action.

MANAGE YOUR EMOTIONS

It is normal to experience a range of emotions when discussing issues around your separation. You may feel upset, frustrated, and angry at times during the mediation. The best thing to do when you feel this way is to request a break or the opportunity to talk privately to your practitioner. 

LISTEN & BE OPEN-MINDED

Generally, it is hard to hear what the other person is saying when you disagree. Instead of interrupting or being quick to say ‘no’, listen, take notes and think flexibly. You could say ‘I’ll think about it’. It can then be helpful to ask questions to gain a better understanding of what the other person has said and put yourself in their shoes. By doing this, you may consider something that you have not thought of before. This does not necessarily mean that you will agree.  

FOCUS ON WHAT IS IMPORTANT TO YOU

Stay calm and focus on understanding the issues and finding workable solutions. Ask yourself what is important and what matters most. Think about what it would be like to resolve your matters and move forward.
